ARTICLE 1 – GENERAL PROVISIONS
1.1) Right of Withdrawal
The BUYER may withdraw from this contract within fourteen (14) calendar days of receipt of goods, without penalty or justification.
1.2) Eligibility Conditions
To exercise this right, the BUYER shall ensure returned goods are:
(a) Unused, unwashed, and in original packaging;
(b) Accompanied by all tags, manuals, and accessories;
(c) Accompanied by the original invoice or proof of purchase.
1.3) Non-Returnable Items
The right of withdrawal is expressly excluded for:
(a) Custom-made or personalized items (e.g., monogrammed car seat covers);
(b) Child safety products (car seats, carriers) with broken hygiene seals;
(c) Goods damaged post-delivery due to BUYER’s actions.
ARTICLE 2 – RETURN PROCEDURE
2.1) Initiation of Return
The BUYER must:
(a) Notify the SELLER in writing via email to returns@kidyphyllisinteriors.com within the 14-day period;
(b) Receive a Return Merchandise Authorization (RMA) number prior to shipment.
2.2) Return Shipping
(a) Domestic (Kenya): SELLER covers costs if the return results from SELLER error (wrong/damaged item).
(b) International: BUYER bears all return shipping and customs costs, unless the return is due to SELLER error.
2.3) Refund Processing
(a) Refunds will be issued within fourteen (14) business days of SELLER receiving the returned goods;
(b) Original shipping fees are non-refundable;
(c) Refunds will be issued via the original payment method.
ARTICLE 3 – EXCHANGES
3.1) Exchange Conditions
The BUYER may request an exchange for:
(a) A different size/color of the same product (subject to availability);
(b) A product of equal value (price difference must be settled).
3.2) Exchange Procedure
(a) The BUYER must follow the return process in Article 2;
(b) The SELLER will dispatch the replacement item within five (5) business days of receiving the returned goods.
ARTICLE 4 – DEFECTIVE OR NON-CONFORMING GOODS
4.1) Warranty Claims
Goods deemed defective or non-conforming to order specifications shall:
(a) Be eligible for full refund or replacement at SELLER’s discretion;
(b) Have return shipping costs covered by the SELLER.
4.2) Reporting Deadline
The BUYER must notify the SELLER of defects within forty-eight (48) hours of delivery.
ARTICLE 5 – INTERNATIONAL RETURNS
5.1) Additional Provisions
(a) The BUYER is responsible for any import duties on returned goods;
(b) Refunds exclude originally paid customs taxes;
(c) SELLER reserves the right to refuse returns that violate destination country regulations.
ARTICLE 6 – GOVERNING LAW & JURISDICTION
6.1) Governing Law
This policy shall be construed under Kenyan law, with disputes subject to the jurisdiction of Nairobi courts.
6.2) Policy Updates
The SELLER reserves the right to amend this policy, with changes effective upon posting to the website.
